(2) How we use your data:
AK Copyright uses personal data only to execute the services, as stated in the cooperation agreement, with the Client. The data protection practices of AK Copyright comply with the European Act of the General Data Protection Regulation (GDPR) from the 10th of May 2018 (Journals of Law: OJ L 119, 4.5.2016, p. 1–88 (with all later changes). AK Copyright will be the controller of the Client’s personal data during the execution of this agreement.
(3) What data do we collect:
To meet the purpose of our cooperation agreement with you, such as finding copyright infringements, preparing the cases, and handing them over to the lawyers, debt collectors, and evidence providers with whom AK Copyright has valid data processing agreements that comply with GDPR and for which you had given us permission before and/or signed a Power of Attorney, settle your cases and transfer your money, we need to obtain some of your personal data. This includes personal identification information such as name, surname, email address, phone number, personal or business address, website, taxation or VAT number, ID number, date of birth, and bank account data. The data will not be subject to automated processing or automated decision-making.
(4) Consent – How we collect data:
AK Copyright collects and processes your data only under your consent, e.g. after having sent it to us via email or having used the contact form on www.akcopyright.com, which is understood as an explicit affirmative action, which signifies an agreement to personal data being processed. We ask you for explicit permission when signing the cooperation agreement. Not being able to store and use your personal data stated above, eventually may lead to the inability to properly execute our service as described in the cooperation agreement. Of course, you can withdraw your consent at any time via postal mail or email.
(5) Our affiliates – recipients of your personal data:
Our affiliates – lawyers, debt collectors, and evidence providers for whom you have given us permission to hand over cases, are using these data to process copyright matters, as well as trusted external services and software in order to comply with fulfilling our service and based on 6 Abs. 1 S. 1 lit. b GDPR.
(6) The retention periods for the personal data:
We are storing and processing a Client’s data until the termination of our contract is finalized. That means until all pending cases that AK Copyright is conducting are settled or closed and all legally necessary billing procedures are finalized (Art. 5 para. 1 lit. e GDPR)
(7) Your individual rights as the personal data owner:
Under GDPR regulations, you have the right:
· to be informed about and get access to your data
· to object to processing that – in your opinion – is likely to cause or is causing damage or distress
· to prevent processing for direct marketing
· to object to decisions being taken by automated means
· in certain circumstances, to have inaccurate personal data rectified, blocked, erased or destroyed
· to claim compensation for damages caused by a breach of the GDPR Act
(8) The right to lodge a complaint with the supervisory authority:
Should you want to file a complaint against AK Copyright in regard to your data protection, you can do so at the Personal Data Protection Office (Urzad Ochrony Danych Osobowych) located in Warsaw, Poland.
